Norwagon Terms & Conditions
1. General definitions
1.1 The Owner is Norwagon via Tromso Hostel AS.
1.2 The Driver is the renter of the vehicle in this agreement.
1.3 The Rental Period starts with the owner handing over the vehicle and ends when the renter returns it.
1.4 The renter agrees to the following terms & conditions by signing the Rental Agreement.
2. Age and Driving license of the Renter
The renter and any driver of the vehicle must be at least 21 years old and hold a valid driver license for at least two years. In Norway driver licenses are valid if printed in English, French, German, Norwegian, Swedish or Danish.
3. Cancellation Policies
3.1 The cancellation claim must be made via e-mail to booking@norwagon.com.
3.2 If cancellation is made up to 30 days before the date of arrival no fee is charged and a full refund is issued. If the reservation is cancelled less than 30 days before arrival – full cost of rental is charged. Not showing up also incurs in a full cost of rental charged. Any changes made to the reservation after checking in are not refundable.
4. Payments and Deposit
4.1 Payment of the rental charge must be made via our website www.norwagon.com at the time of reservation.
4.2 The safety deposit is charged 48hours before the arrival date via email, to be paid through any of our payment providers beds24, Paypal or Stripe. Norwagon shall retain this deposit to be used, in the event of loss of or damage to the vehicle during the term of this Agreement, to cover fully or partially the cost of necessary repairs or replacement. In the absence of damage or loss, said deposit will be refunded to the Renter within 5 working days.
4.3 Additional payments may be required from the renter, and will be deducted from the deposit in case of:
4.3.1 Returning the vehicle without refilling will incur in a charge of a 500NOK plus the cost of refueling.
4.3.2 Picking up or dropping off vehicles can be made from 09:00 to 17:00. Delivery of vehicles outside this schedule has to be arranged via e-mail and may incur in a 500NOK fee. Not returning the vehicle at the date and location agreed in this contract and not communicating the intention of extending the rental period will incur in a 500NOK fee plus a charge of 1’000NOK for each hour extension period over the agreed time of handing over of the vehicle.
4.3.3 Returning the vehicle in an excessively dirty condition. This includes, but is not limited to, the cockpit seats, doors and dashboard shelves as well as the back of the vehicle including pillows, seats, duvets, kitchen stove and sink and all other utensils related – This will incur in a charge of 500NOK.
4.3.4 Infringement of traffic and/or parking offences, tolls and others – This will incur in a charge of 500NOK per claim, plus the cost of the offence and/or toll.
4.3.5 Returning the vehicle with damage sustained during the rental period will incur in a charge of 500NOK plus the cost of repairs.
4.3.6 Collision with other vehicles or property damage of any kind where the insurance is activated, there will be an administration fee of 1’000NOK per claim lodged plus the cost of repairs.
5.Insurance
Insurance is included in the price and has an excess of 5’000NOK. This includes a valid liability insurance of operations, mandatory vehicle insurance which includes liability insurance for the driver and owner, and third party liability insurance in accordance with Norwegian law. This insurance however, does not cover the following:
a. Intentional damage or damage due to gross negligence by the driver;
b. Damage resulting from the driver being under the influence of alcohol, stimulants or sedatives or otherwise incapable of controlling the vehicle in a secure manner;
c. Damage due to racing or test driving;
d. Damage owing to war, revolution, civil unrest or rioting;
e. Damage inflicted by animals;
f. Holes burned into seats, carpets or mats;
g. Damage affecting only wheels, tires, suspension, batteries, glass (other than windows), radio receivers or loss by theft of parts of the vehicle and damage resulting from this;
h. damage caused by driving on rough roads, such as damage to the vehicle’s transmission, drive or other components in or attached to the chassis; damage to the chassis resulting from the vehicle scraping the surface of rough roads as a result of ridges left by road graders, stones lodged in the road surface or at the edge of the road. The same applies to damage from stones being thrown up and striking the underside of the vehicle during driving.
i. Damage resulting from driving in places where it is not permitted to, such as on tracks, rough trails, in snowdrifts, on ice, across unbridged rivers or streams, on beaches, on causeways accessible only at low tide or in other off-road areas. However, compensation will be paid for damage resulting from the driver being forced to leave the roadway, e.g. for roadside repairs.
j. Damage to passenger vehicles that occurs during driving on off-road on official maps;
k. Damage caused by sand, gravel, ash, pumice or other earth material being blown onto the vehicle;
l. Water damage to the vehicle;
m. Damage caused by sea spray and/or seawater if the vehicle is transported by sea;
n. Damage caused from towing another vehicle.
6. Obligations of the Renter
6.1 The Renter shall return the vehicle with all accessories, including tires, tools, documents, maps and other items delivered with the vehicle, in the same condition as they were received, except for normal wear and tear from use.
6.2 The Renter shall return the vehicle with a full tank and at the time and location agreed on the contract. Otherwise refer to 4. Payments and Deposit points 4.3. of this Terms and Conditions document.
6.3 The vehicle shall be handled and driven carefully. The Renter is liable for all damages resulting from use of the vehicle that will not be compensated for by the Owner’s insurance company, which includes, but is not limited to all situations described in points a. to m. listed in 5. Insurance.
6.4 In the event of a collision or accident, the Renter shall immediately notify the appropriate police authorities as well as the Owner of the event. The Renter shall not leave the scene before the police have arrived. The Renter shall immediately fill out damage reports if necessary. Failure to do this will make the renter fully liable and to forfeit their deposit.
6.5 The Renter agrees to all that is stipulated by 4. Payments and Deposit.
6.6 The Renter agrees that the 24hour Roadside Assistance included is to be used on all inherent mechanical faults. For other situations such as refueling, jump starting, tire related incidents, lost keys, etc. a 500NOK fee will be applied and the situation resolved between the Renter and the Owner when possible. Otherwise, the renter covers the costs if applicable.
7. Obligations of the Owner
7.1 The Owner undertakes to deliver the vehicle at the agreed time and location.
7.2 In the event of vehicle malfunction for reasons the Renter is not responsible, the Owner shall provide the Renter with another vehicle if possible or ensure that a repair is made. If this is not possible, the Owner will guarantee the Renter a safe return to Tromso and a refund will be made for the remainder of the rental period.
8. General provisions
8.1 Rental Agreement and other vehicle documents shall be kept in the vehicle at all times during rental period.
8.2 The Renter acknowledges by his or her signature to this rental agreement that he or she received the vehicle and all accessories included in good conditions. Refer to Rental Agreement point 2.6 Existing Damage.
8.3 Norwegian law applies to agreements made on the basis of the terms cited above. This includes any claims for compensation that might be made. This applies both to the basis for and the calculation of compensation. The same applies to claims for damages based on liability outside this agreement. If legal disputes arise concerning this rental agreement, they will be heard before the Owner’s legal venue.
